Acceptance of Terms

By accessing or using WatchGold.org (the "Platform"), including any content, data, tools, or services offered on or through the Platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Platform. These Terms constitute a legally binding agreement between you and WatchGold.org. We may update these Terms from time to time, and your continued use of the Platform after any such changes constitutes your acceptance of the new Terms. You are advised to review these Terms periodically.

Educational Purposes Only

WatchGold.org and all associated services, content, data, and materials are provided exclusively for general informational and educational purposes. The Platform does not provide investment advice, financial guidance, commodity trading advice, legal advice, tax advice, accounting advice, or fiduciary advice. Under no circumstances should any content on this Platform be construed as a personalized recommendation or solicitation to buy, sell, or hold any security, commodity, or financial instrument. Subscription Services

The Platform offers paid subscription tiers (including "Pro" and any future tiers) that provide access to enhanced data, analysis, tools, and features. Subscription services are provided for informational and educational purposes only and do not constitute advisory services, brokerage services, managed accounts, portfolio management, or personalized investment recommendations.

Subscription Process

To subscribe, you must create an account with valid credentials and select a subscription plan. By completing the subscription process, you confirm that you have read and agree to these Terms, including the payment and cancellation provisions below. Subscription access begins immediately upon successful payment processing.

Payment & Billing

Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your selected plan). By subscribing, you authorize recurring charges to your payment method at the then-current rate. All fees are stated in US dollars unless otherwise indicated. We reserve the right to modify pricing with at least thirty (30) days' advance notice; price changes will apply to billing cycles commencing after the notice period.

Cancellation & Refunds

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period, and you will retain access to premium features until that date. No pro-rated refunds will be issued for partial billing periods. Subscription fees are non-refundable except as required by applicable law.

Auto-Renewal

All subscriptions automatically renew at the end of each billing period unless cancelled prior to the renewal date. You will be charged the then-current subscription rate upon each renewal. It is your responsibility to cancel before the renewal date if you do not wish to continue your subscription.

Account Terms

By creating an account on the Platform, you represent and warrant the following:

  • You must be at least 18 years of age or the age of majority in your jurisdiction to create an account and use the Platform
  • You are responsible for providing accurate and current account information and for maintaining the confidentiality of your credentials
  • You are solely responsible for all activity that occurs under your account, and you agree to notify us immediately of any unauthorized use
  • We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason at our sole discretion
  • Each individual may maintain only one account; creating multiple accounts to circumvent restrictions or abuse free trials is prohibited
  • Account credentials are personal and non-transferable; sharing login credentials with third parties is strictly prohibited and may result in immediate account termination
  • You are solely responsible for ensuring that your use of the Platform complies with all applicable laws and regulations in your jurisdiction

User Obligations

As a condition of your access to and use of the Platform, you agree to the following obligations:

Legal Compliance

You shall comply with all applicable local, state, national, and international laws, rules, and regulations in connection with your use of the Platform. You represent that you are not located in, or a citizen or resident of, any country or jurisdiction where use of the Platform would violate applicable law.

Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Redistribute, resell, sublicense, or commercially exploit any content, data, or materials from the Platform without prior written permission
  • Use automated systems, bots, scrapers, crawlers, or similar tools to access, extract, or collect data from the Platform
  • Attempt to circumvent any access controls, authentication mechanisms, paywalls, or usage restrictions
  • Use the Platform for any illegal, fraudulent, or unauthorized purpose
  • Interfere with or disrupt the integrity, security, or performance of the Platform or its underlying infrastructure
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or algorithms of any Platform software or tools
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
  • Harvest, collect, or store personal information of other users without their express consent
  • Upload, transmit, or distribute any viruses, malware, worms, Trojan horses, or other harmful code
  • Use the Platform to develop, directly or indirectly, any product or service that competes with the Platform

Account Security

You are responsible for safeguarding your account credentials (username, password, and any two-factor authentication codes). You agree to immediately notify WatchGold.org of any unauthorized use of your account or any other breach of security. WatchGold.org will not be liable for any loss or damage arising from your failure to comply with this provision.

Customer Liability

You acknowledge and agree that you are solely responsible for all activities conducted through your account and for any content you submit, post, or transmit via the Platform. You bear full responsibility for any consequences, financial or otherwise, resulting from your use of the Platform or reliance on any content provided herein.

Indemnification

You agree to indemnify, defend, and hold harmless WatchGold.org, its affiliates, operators, contributors, licensors, and their respective directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

Intellectual Property

All content, trademarks, logos, data compilations, software, and proprietary materials on this Platform are the property of WatchGold.org or its licensors and are protected by applicable copyright, trademark, and intellectual property laws. No content may be reproduced, distributed, modified, or republished without prior written permission, except as expressly permitted by law or by the applicable license terms. Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform content for personal, non-commercial purposes.

Exclusion of Warranties

The Platform and all content, data, tools, and services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. WatchGold.org expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. WatchGold.org does not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. No advice or information, whether oral or written, obtained from the Platform shall create any warranty not expressly stated in these Terms.

Limitation of Liability

To the fullest extent permitted by applicable law, WatchGold.org, its affiliates, operators, contributors, sponsors, and their respective directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages arising from or related to the use of, or inability to use, this Platform or any content therein — including but not limited to trading losses, loss of profits, opportunity costs, data loss, or reputational loss. The total aggregate liability of WatchGold.org to you for any claim shall not exceed the amount you paid for subscription services in the twelve (12) months preceding the claim, or fifty US dollars (USD $50), whichever is greater.

Termination

WatchGold.org may, in its sole discretion, suspend or terminate your access to all or any part of the Platform at any time, with or without cause, with or without notice, effective immediately. Without limiting the foregoing, grounds for termination include violation of these Terms, fraudulent or illegal activity, non-payment of subscription fees, or conduct that WatchGold.org reasonably believes is harmful to other users or the Platform. Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

Third-Party Links & Services

The Platform may contain links to third-party websites, services, or resources that are not owned or controlled by WatchGold.org. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that WatchGold.org shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such third-party websites or services.

Data Provider Terms

Market data, pricing information, and other financial data displayed on the Platform are sourced from third-party data providers and are subject to those providers' terms of use, licensing agreements, and redistribution restrictions. Users acknowledge that: (a) real-time data may not be available and displayed data may be delayed by 15–20 minutes or more; (b) data providers may impose additional restrictions on data usage; (c) WatchGold.org is not responsible for the accuracy or completeness of third-party data; and (d) certain data may only be available to subscribers in accordance with data provider licensing requirements. Governing Law & Dispute Resolution

These Terms and any disputes arising out of or related to the use of this Platform shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms or the use of the Platform shall be resolved exclusively through binding arbitration administered in accordance with the rules of the American Arbitration Association, with the arbitration to take place in the State of Delaware. You agree to waive any right to a jury trial or to participate in a class action.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms, and the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Entire Agreement

These Terms, together with our Privacy Policy, Legal Disclaimer & Risk Disclosure, and any other legal notices or agreements published on the Platform, constitute the entire agreement between you and WatchGold.org regarding your use of the Platform and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.

Assignment

You may not assign or transfer these Terms, or any rights or obligations hereunder, without the prior written consent of WatchGold.org. WatchGold.org may freely assign or transfer these Terms, in whole or in part, without restriction and without notice to you. Any attempted assignment in violation of this provision shall be null and void. Subject to the foregoing, these Terms shall be binding upon and inure to the benefit of the parties and their respective successors and assigns.

Modifications

We reserve the right to modify, amend, or update these Terms at any time. Material changes will be communicated through the Platform or via email. Continued use of the Platform following any modifications constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of the Platform and cancel your subscription.
