Terms of Service

These Terms of Service (the "Terms") govern access to and use of WatchGold.org and its related websites, applications, newsletters, member areas, downloads, tools, AI features, and content offerings (collectively, the "Platform"). The Platform is owned and operated by WatchGold, Inc., a Delaware corporation ("WatchGold," "Company," "it," or "its"). By accessing or using the Platform, a user agrees to these Terms. If a user does not agree, that user must not access or use the Platform.
1. Nature of the Platform
WatchGold.org is an educational and informational platform focused on gold, precious metals, market-related information, and related subject matter. The Platform does not sell products or services through the site, and it does not provide investment advice, legal advice, tax advice, accounting advice, financial advice, or other professional advice.
Nothing on the Platform constitutes or should be understood as:
- investment advice or a recommendation;
- a research report, rating, or signal;
- an offer, solicitation, or recommendation to buy, sell, hold, trade, hedge, store, insure, finance, or otherwise transact in any asset, security, commodity, or service; or
- personalized advice for any user.
2. Eligibility
The Platform is intended for users who can form legally binding contracts under applicable law. The Platform is not directed to children under 13, and WatchGold does not intend to target minors under 16.
3. Accounts and Membership Features
Certain features of the Platform may require account creation, login credentials, newsletter enrollment, or submission of information. Users must provide accurate, current information and are responsible for maintaining the confidentiality of their credentials and for all activity occurring under their accounts.
WatchGold may suspend, restrict, or terminate accounts or feature access at any time if it believes a user has violated these Terms, created risk, misused the Platform, or engaged in unlawful or harmful conduct.
4. User Conduct
Users may not:
- use the Platform in violation of any applicable law or regulation;
- interfere with the operation, security, or availability of the Platform;
- scrape, crawl, harvest, or systematically extract content or data except as expressly authorized in writing;
- upload, submit, or transmit unlawful, infringing, defamatory, malicious, deceptive, or harmful material;
- input sensitive personal information, confidential information, or unauthorized third-party data into AI or interactive tools where prohibited by Platform instructions; or
- attempt to reverse engineer, probe, bypass, or disable technical or security restrictions.
5. Educational Content; No Reliance
All content on the Platform is provided solely for general educational and informational purposes. Content may include articles, commentary, data visualizations, tools, downloadable materials, newsletters, AI-generated outputs, alerts, summaries, charts, source references, sponsor references, and third-party links.
Users are solely responsible for evaluating any content made available on the Platform. Content may be incomplete, delayed, inaccurate, outdated, simplified, or presented without full context. Any reliance on the Platform or its content is at the user’s own risk.
Users must independently verify information and consult qualified professionals before making financial, legal, tax, business, technical, trading, valuation, or compliance decisions.
6. Tools, Alerts, Downloads, and Data Features
The Platform may provide downloadable reports, watchlists, alerts, charts, dashboards, calculators, data views, rankings, summaries, educational prompts, model outputs, scenario tools, and similar features. These features are intended solely for education and information.
No such feature is intended to be, and none should be interpreted as, a recommendation, trading signal, investment signal, rating, research report, or advice of any kind. Labels, scores, classifications, summaries, and rankings may be heuristic, editorial, model-assisted, or simplified and may not reflect full market context.
Past performance, historical patterns, data displays, or illustrative scenarios do not predict future results.
7. AI Features
The Platform may offer AI-assisted features, including chat, search, summarization, extraction, educational Q&A, tagging, drafting, or related functions. AI outputs are automatically generated and may be inaccurate, incomplete, biased, stale, misleading, or unsuitable for a user’s intended purpose.
AI outputs are provided only for general informational and educational use and must not be treated as professional advice, factual certification, due diligence, research, or a substitute for independent review.
Users are solely responsible for reviewing and verifying any AI output before acting on it, sharing it, or incorporating it into other materials.
8. Advertising, Sponsorships, and Outbound Sponsor Links
The Platform may display advertisements, sponsored content, native advertising, partner placements, and sponsored labels. Paid placement on the Platform does not mean WatchGold recommends, endorses, verifies, or guarantees any advertiser, sponsor, product, service, or claim.
WatchGold may receive payment for sponsorship placement on the Platform. Except for sponsorship placement arrangements, WatchGold does not receive compensation based on whether a user clicks a sponsor link, visits a sponsor platform, or completes a transaction with a sponsor. Sponsor links are provided as a user-convenience feature to allow seamless navigation to third-party platforms.
Paid reviews are not accepted in exchange for favorable ratings or favorable editorial conclusions.
Users remain solely responsible for evaluating any sponsor, advertiser, linked service, or third-party offer before relying on it or transacting with it.
9. Third-Party Links and Services
The Platform may link to or reference third-party websites, data providers, sponsors, platforms, APIs, or services. WatchGold does not control and is not responsible for third-party content, data, availability, privacy practices, terms, products, services, or conduct.
Use of third-party sites and services is at the user’s own risk and subject to the applicable third party’s terms and policies.
10. Intellectual Property
Except for user-submitted content and third-party materials used under license or attribution terms, the Platform and its text, graphics, design, arrangement, branding, software, and functionality are owned by or licensed to WatchGold and protected by intellectual property laws.
Subject to these Terms, WatchGold grants users a limited, revocable, non-exclusive, non-transferable license to access and use the Platform for personal, internal, non-commercial educational use. No right is granted to reproduce, republish, distribute, commercially exploit, or create derivative works from Platform content except as expressly permitted by law or with written permission.
11. Data Sources and Attribution
Certain data, prices, benchmarks, charts, and source materials displayed on the Platform are obtained from third-party providers or public sources and may be subject to attribution requirements, license conditions, or redistribution limits. Users may not assume that all data displayed on the Platform may be copied, redistributed, or reused for commercial purposes.
WatchGold may display attribution notices or source statements required by applicable data providers or agreements.
12. User Submissions
If a user submits content, prompts, comments, files, messages, suggestions, or feedback through the Platform, that user represents that the submission is lawful and that the user has sufficient rights to provide it. To the extent necessary to operate, secure, improve, and provide the Platform, the user grants WatchGold a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, adapt, display, and use the submission, subject to the Privacy Policy.
13. Privacy
Use of the Platform is also governed by the WatchGold.org Privacy Policy. /privacy.
14. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED ON AN "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" BASIS. WATCHGOLD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THAT THE PLATFORM WILL BE SECURE, UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WATCHGOLD, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, SERVICE PROVIDERS, AND DATA SOURCES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, BUSINESS OPPORTUNITY, OR TRADING/INVESTMENT LOSSES, ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WATCHGOLD’S AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).
16. Indemnification
Users agree to defend, indemnify, and hold harmless WatchGold and its affiliates, officers, directors, employees, contractors, licensors, and service providers from and against claims, liabilities, damages, losses, and expenses arising from or related to the user’s misuse of the Platform, violation of these Terms, violation of applicable law, or violation of any third-party rights.
17. Termination
WatchGold may suspend or terminate access to the Platform, in whole or in part, at any time, with or without notice, if it believes a user has violated these Terms, created risk, or misused the Platform.
18. Changes to the Terms
WatchGold may revise these Terms from time to time. Revised Terms become effective when posted unless a later date is stated. Continued use of the Platform after revised Terms are posted constitutes acceptance of the revised Terms.
19. Governing Law and Venue
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Unless applicable law requires otherwise, exclusive jurisdiction and venue for disputes arising out of or relating to these Terms or the Platform will lie in the state or federal courts located in Delaware.
